Terms of Use

“Service” means the website, informational content, and any related online features operated by the Company at the domain above.

2.1  By accessing the Service you represent that you are at least 18 years of age and legally able to enter into a binding agreement. If you do not agree to these Terms, you must not use the Service.

2.2  The Service is intended for users in the United States. If you access it from other jurisdictions, you do so on your own initiative and are responsible for compliance with local law.

3.1  The Service provides information about the Company's pest control, termite control, mosquito control, rodent control, and related services offered in the State of Florida. Any quotes, scheduling, and work performed are governed by a separate service agreement between the Company and the customer.

3.2  The Service is provided “as is” and may be updated, modified, or discontinued at any time without notice.

You agree not to:

• Use the Service in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to any portion of the Service, its servers, or related systems.
• Interfere with or disrupt the integrity or performance of the Service, including through automated scraping, denial-of-service attacks, or malware.
• Reverse engineer, decompile, or disassemble any portion of the Service except to the extent expressly permitted by law.
• Use the Service to transmit spam, harassing content, or fraudulent communications.
• Impersonate the Company or any of its employees, or misrepresent your affiliation with the Company.

5.1  All Content on the Service, including but not limited to the My NativePestManagement name, logo, trade dress, graphics, and editorial text, is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws.

5.2  You are granted a limited, non-exclusive, non-transferable license to view the Content for personal, non-commercial purposes. No other rights are granted, including rights to copy, reproduce, distribute, or create derivative works, without prior written consent from the Company.

6.1  We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, the Company, or third parties.

6.2  Upon termination, the provisions of Sections 5, 7, 8, 10, and 11 survive.

THE SERVICE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. THE COMPANY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. ANY RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE IS AT YOUR SOLE RISK. SPECIFIC PEST-CONTROL OUTCOMES DEPEND ON SITE CONDITIONS AND CAN ONLY BE WARRANTED, IF AT ALL, UNDER A SEPARATE WRITTEN SERVICE AGREEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, OUR AGGREGATE LIABILITY SHALL BE LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

We may revise these Terms from time to time. Revised Terms take effect upon posting to the Service. Material changes will be indicated by updating the Version and Effective Date above. Your continued use of the Service after revised Terms are posted constitutes acceptance of those revisions.

10.1  These Terms are governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict-of-law principles.

10.2  Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and the parties consent to the personal jurisdiction of those courts.

10.3  If any provision of these Terms is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
